Protection of The State Towards The Rights of Citizens by The Enforcement of Death Penalty For Drug Offenders in Indonesia

These days however, drug abuse and crimes are widespread and increasingly taking lives while violating the rights of citizens who should be protected under the law. Being a threat to the country, the government searched for a solution to minimize if not completely end these offenses. One step taken was the enforcement of the death penalty for drug offenders which is stated under  law number 35 of 2009 on Narcotics. The passing of this law was intended to protect the rights of the citizens. From the aspects which influenced the problems in research of this thesis raised some problems, which are : how are function and responsibilities of the state to enforce the right of the citizens linked with the impact of narcotics and  how the enforcement of the death penalty for drug offenders related to human rights in Indonesia.

In order to find a solution for the existing problems, research is done by using the juridical normative approach which is a method of research conducted with drip at a series of data libraries called secondary data through legal principles and legal norms contained in the legislation.

Departing from the results of research of these problems, you may conclude that as a Constitutional State, Indonesia uses the law to enforce stability and maintain order in society; part of this responsibility is the enforcement or protection of the rights of its citizens. The rights of the citizens are protected by our constitution and by several legislation. For instance, law number 39 of 1999 on Human Rights and law number 12 of 2005 on Ratification of International Covenant on Civil and Politics Rights are two of the many laws created by our government. According to the law, the government needs to respect, protect, enforce, and promote human rights. One of the protection that state must give its citizens is the enforcement of death penalty for drug offenders stated under  law number 35 of 2009 on Narcotics. The enforcement of death penalty for drug offenders is not violating the human rights rather it is promoting law and order.
